Independent Medical Examinations

If you are receiving benefits for a work-related injury, your employer or its insurance company has the right to order an independent medical examination (IME) by a doctor of its own choosing every six months. In the vast majority of cases, these examinations are anything but "independent." The doctors who perform the examinations are being paid by the insurance company, so they are motivated to report findings that show you are fully recovered or that your injury had nothing to do with your job.

If you have received a notice for an upcoming IME, you could eventually face a challenge from the insurance company for the modification, suspension or termination of your workers' compensation benefits. Before you go to your IME or speak to anyone from the doctor's office, talk to an experienced workers' compensation attorney who can help you understand your rights and prepare you for the examination.

Dedicated Pennsylvania Workers' Compensation Lawyers

At the Law Offices of Katherine L. Niven & Associates, PC, we are committed to helping injured workers secure the financial and medical benefits they need. After more than 25 years dedicated to protecting the interests of the injured and disabled, we have come to understand that there is almost nothing insurance companies won't do to avoid paying a claim. Even in the most clear-cut cases, they will subject injury victims to IMEs or other procedures in order to protect their own bottom lines.

When you hire our firm, we will conduct a thorough review of your case. We will do our best to prepare you for the types of questions the doctor or medical staff is likely to ask and explain how the information you provide might be used in an attempt to reduce or cut off your benefits. If any adverse action is taken as a result of your IME, you can rely on us to do everything in our power to curtail any effort to withhold the benefits you are entitled to under the law.
