Under the law, you have the right to file an appeal if you disagree with the workers' compensation judge's opinion.

Appeals go to the Workers' Compensation Appeal Board, and it is a paper-only review. By this, we mean there are no further hearings and you do not appear, although there may be brief oral argument by your attorney.

Workers' compensation appeals are usually not successful because the workers' compensation judge is the ultimate finder of fact and makes the determinations as to credibility. This means, basically, that whomever the judge chooses usually wins unless he or she has made a significant error of law.
