You have the right to appeal a workers’ compensation denial

If you are injured on the job, it won't be long before you consider the idea of filing a claim for workers' compensation benefits.

It's easy to believe that you're guaranteed to receive benefits, but nothing could be further from the truth.

There are many reasons why claims are denied, such as when an employer argues that the employee was not injured on the job.

If your initial workers' compensation claim is denied, you have the right to file an appeal. This isn't something you want to do, as you have enough on your plate, but it's something that you should tackle without delay.

Review your denial letter in great detail, paying close attention to the steps that are required of you. For example, make note of the date by which you need to file your appeal.

Furthermore, don't jump the gun just yet. You may be able to contact your employer and/or insurance company to work things out without filing an appeal.

To win your appeal, it's imperative to include as much documentation as possible, such as medical records that backup your claim.

If you're lucky, your workers' compensation claim will be approved the first time around. This will allow you to receive benefits until you are able to return to work.

However, if your claim is denied for any reason, don't hesitate to file an appeal. Once you learn more about the denial and your rights, you can begin your fight to receive benefits in the near future. If you're unsure of what to do next, a legal professional can provide guidance.
