Can you be terminated for filing a workers’ compensation claim?

If you are injured on the job, you may begin to wonder if it makes sense to file a workers' compensation claim.

Even though you realize the many benefits of receiving workers' compensation, you may have some concerns about pushing forward. Here's why: You have reason to believe that your employer will terminate your employment.

As a Pennsylvania worker, for example, you are employed in an at-will state. This means that unless you have a contract or are part of a union, your company can terminate your employment at any time.

However, your employer does not have the power to fire you for filing a workers' compensation claim.

Your employer can terminate your employment for reasons associated with workers' compensation, such as if you refuse to take on a light duty job as you make your way toward a full recovery.

At our law firm, we understand that many people are afraid to file a workers' compensation claim because they believe it will lead to a termination of employment. While this is a concern, we do whatever it takes to step in and help our clients get the compensation they deserve, all the while keeping their job safe.

If you have reason to believe you have lost your job as the result of making a workers' compensation claim, you need to learn more about your legal rights. You have enough on your plate right now that you don't need to have concerns about the stability of your job. It may not be something you want to do, but you may have to take action against your former employer.
