Why Marzzacco Niven & Associates' Adam Crosier and Jesse Rhodeside Believe Governor Wolf Should Veto the Drug Formulary Bill for Injured Workers

The state Legislature recently passed legislation endangering injured workers' access to medications prescribed by their treating physicians, and, unless Governor Wolf takes swift action by vetoing Senate Bill 936, a state-sanctioned list, or formulary, will dictate which drugs injured workers could receive from employers under the Workers' Compensation Act. The formulary, and not the treating physician most familiar with the injured worker, would dictate dosage, duration and number of drugs doctors could prescribe. 

Adam Crosier, a Certified Worker's Compensation Specialist at Marzzacco Niven & Associates said the Governor should veto the bill "so legitimate treatment options are not denied to Injured Workers in Pennsylvania."

Currently, the Workers' Compensation Act allows the doctor to prescribe medicine and the patient to get it right away. Under the bill, the employer and insurance company could block access to drugs until satisfied the patient and doctor have provided proof of need. This would greatly impact an injured workers' ability to receive adequate medical treatment for their injuries, and potentially delay recovery times and ability to return to work. Signing this bill does nothing other than put more money into the insurance companies' pockets at the expense of injured workers. Governor Wolf should veto this Senate Bill 936 and protect injured workers from politicians interfering with their access to vital medications.

Jesse Rhodeside, an experienced Worker's compensation lawyer at Marzzacco Niven said of the bill, "The formulary proposal is a 'one size fits all' solution to a wide range of problems that doctors should address individually with their patients. Insurance companies should not make these decisions for workers."
