Attorney Faith Pensinger Obtains Settlement in Sex Discrimination Case Against City of Harrisburg

Attorney Faith Pensinger of Marzzacco Niven & Associates won a settlement for a former police sergeant in Harrisburg. The sergeant claimed she was passed over for promotions three times over 19 years because of her sex. Ms. Pensinger’s client filed lawsuits under the Civil Rights Act of 1964 and Pennsylvania’s Human Relations Act.
The client states that she attempted for years to secure a position in Harrisburg’s Criminal Investigation Division (CID) and that the city promoted two men with lower civil service test scores over her. The client retired early in January 2024 after being assigned an overnight patrol shift, which made it difficult for her to care for her family.
In response to the lawsuit, the city claimed that the patrol assignment was a voluntary promotion. It also claimed that the CID job was less desirable because it required daily, 24-hour on-call hours.
As part of the settlement, the city agreed to pay Ms. Pensinger’s client $22,500 to drop the lawsuit. Per the agreement, the city did not admit to any wrongdoing.
