Ben Salvina Secures Confidential Six-Figure Employment Law Settlement for Victim of Sexual Harassment and Assault

Ben Salvina of Marzzacco Niven & Associates recently achieved an exceptional result for a client who had turned to the firm for help in an employment and personal injury matter.

Our client was a long-time employee for the company who was subjected to sexual harassment by the employee’s boss—the company’s owner.  The harassment was reported to management and our client was promptly terminated for reporting it.  Our client had been a marketing executive for the company and had an exemplary employment record, helping the company provide nationwide healthcare services to its clients for years.  Our client’s direct supervisor, the owner, had repeatedly sexually harassed, and on one occasion sexually assaulted, the employee and then retaliated against our client by terminating our client’s employment after our client refused the owner’s repeated advances and reported them to the company’s management team.

After getting involved in the case, investigating the claim and gathering crucial evidence, Ben began negotiating a claim for damages with the employer’s defense lawyer.  In lieu of filing a Civil Complaint in court, Ben was able to get the employer to attend a private mediation.  After a full day of meditation, Ben was able to swiftly negotiate a confidential, six-figure settlement for the client.  Moreover, creative negotiation efforts forced the employer to focus on the alleged sexual assault component of the case.  This move proved crucial to the outcome in the matter, as this tactic allowed the client to receive the entire amount of the settlement income tax-free.

Firm owner Chris Marzzacco commented, “Participating in the case with Ben was a great experience for me, as a personal injury lawyer.  Ben’s handling of this case was extraordinary and his rapport with the client and the mediator made the difference here.  Ben truly believes in his clients’ causes and that was evident here in his ability to successfully resolve a highly emotional, contentious, and complex case. Ben’s willingness to think outside the box at the mediation made the difference for our client.”
