An Overview of Social Security Disability Benefits in Pennsylvania

A law firm devoted to the needs of the disabled

Many people who work never imagine that they will suffer a disability. Yet work-related injuries are more common than you might think. If you suffer a disabling injury, depending on your circumstances, you may be eligible to receive Pennsylvania Social Security benefits. However, benefits are awarded on a case-by-case basis, and the U.S. Social Security Administration examines applicants carefully before awarding benefits.

The attorneys at Marzzacco Niven & Associates have extensive experience in Social Security law. When you choose us to represent you, we take every measure to ensure that your rights are protected and your best interests are maintained.

Types of benefit programs

The Social Security Administration pays out benefits in Pennsylvania to disabled individuals through two programs: Social Security Disability Insurance and Supplemental Security Income.

SSI is a needs-based program designed to assist disabled individuals with low incomes. In order to qualify for SSDI, you must have recently worked and paid taxes. Individuals receiving SSDI become eligible for Medicare after receiving benefits for two years, whereas those receiving SSI are automatically eligible for Medicare.

Benefits for children with disabilities

To receive Social Security Disability benefits for your child, you must provide the SSA with detailed information about the disabling medical condition. In addition, your child must:

  • Not be working and earning more than a specified amount per year, which changes annually.
  • Must have a physical or mental condition, or a combination of conditions, that result in “marked and severe functional limitations” in performing activities.
  • Have been disabled or be expected to be disabled for at least 12 months, or the condition must be expected to result in death

Each Harrisburg lawyer at our firm has the knowledge, skill, and experience to guide you through the process of filing for SSDI or SSI benefits.
