Injury Law FAQs

In his years of experience representing injured clients throughout Pennsylvania, Attorney Christopher Marzzacco has answered many injury law questions. Below are answers to some of the most common questions we hear during initial consultations and phone calls. We encourage you to take a look. If you have more questions about an injury claim, please contact us for a consultation at no charge.

Q. What should I do if I have been injured in an accident?

A. First, ensure that everyone involved in the accident is immediately seen by medical professionals. Even if a person does not seem badly injured, it is still necessary to get checked out. If possible, go to the emergency room.

You, or someone on your behalf, should get information from everyone involved in the accident. You can even take information from witnesses on the scene. It is in your best interests to contact a personal injury lawyer as soon as possible after the accident has occurred. When you turn to a legal advocate from Marzzacco Niven & Associates, you can rest assured that your case will be handled smoothly.

Most importantly, never speak to or give a statement to an insurance company without first calling a lawyer. Remember, anything you say now could be used to hurt your case later. If an insurance company tries to speak to you after an accident, politely decline an interview, get their contact information, and call your personal injury lawyer immediately.

Q. How do I get compensation for my injuries?

A. Depending upon your case, you could be eligible to receive compensation from an insurance company or from the negligent company or individual who caused your accident. Any personal injury case does not follow a cookie-cutter approach, and the attorneys at Marzzacco Niven & Associates will work to maximize your chances of full compensation.

Q. Do I need a lawyer?

A. Technically speaking, no. It is not a legal requirement that you be represented by an attorney. However, if you want to get compensation for injuries, it is definitely in your best interests to discuss your case with an attorney who is skilled and experienced in the area of personal injury law. Remember, the insurance companies involved want to save their money, not pay it out in a claim. It is important to have a lawyer who will advocate on your behalf. It is also best to hire a lawyer or law firm that concentrates its practice to representing injury victims only. At Marzzacco Niven and Associates, we have dedicated our practice to raising a voice and representing those injured or killed by others, those injured at work, and those with disabilities.

Q: Will I pay legal fees and costs?

A: The only time you pay a legal fee is when we make a recovery for you or your loved ones by settlement or verdict. This is a “contingent fee.” When Attorney Marzzacco accepts your case, Marzzacco Niven and Associates advances all costs so that you don’t have to pay them out of pocket as the case proceeds. If for some reason we don’t make a recovery for you, you would not owe legal fees or costs. Also, Attorney Marzzacco guarantees that when you settle your case, the amount of his fee and costs will never be more than the amount that you will receive!

Q. Will I have to go to court?

A. It depends on your case. Almost all personal injury cases settle. If your attorney is unable to settle your claim with an insurance company, the attorney will file a complaint and move the case toward mediation, arbitration, or a jury trial. Attorney Marzzacco has tried cases in front of juries, judges, and arbitrators and has the staff and resources necessary to handle your case from start to finish. Attorney Marzzacco has also successfully handled dozens of cases at mediation—an option that may be best for you in certain circumstances.

Q. How long do I have to file a personal injury claim?

A. In most cases in Pennsylvania, you have two years from the date of the injury or the discovery of the injury to bring a formal legal action against the person or company responsible for injuring you. However, you should contact an experienced personal injury lawyer as soon as possible after an accident to ensure the best results.
