What Does FMLA Provide?

After a workplace accident or illness, an employee may be eligible for the following FMLA protections: 

  • Time off for surgery
  • Time off during serious injury recovery
  • Follow-up treatment
  • Physical therapy appointments
  • A reduced work schedule when medically necessary
  • Leave for a serious health condition related to the injury

FMLA also requires covered employers to maintain group health insurance during protected leave under the same conditions as if the employee were still working.

Can a Worker Seek Workers’ Compensation and FMLA Benefits at the Same Time?

Yes. If a work injury qualifies as a serious health condition under FMLA, the employer may count the same absence as both workers’ compensation leave and FMLA leave.

FMLA leave is generally unpaid. Workers’ compensation may pay medical bills and wage-loss benefits. FMLA protects the worker’s job during the covered leave period. That means an injured worker may receive workers’ compensation checks while also being on unpaid FMLA leave.

For example, if a Pennsylvania worker suffers a serious back injury on the job and cannot work for eight weeks, that time may count toward workers’ compensation and FMLA. Workers’ compensation may pay medical bills and wage loss benefits; FMLA protects the worker’s job during the covered leave period.
